Agreement to Terms

By engaging Bearing for services or accessing our website at getbearing.co (“Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not engage our services.

Bearing is a brand operated by Nangy Corp, a California S-Corporation (“Bearing,” “we,” “us,” or “our”). These Terms apply to all clients and website visitors.

Service Description

Bearing builds and operates AI receptionists for small businesses — restaurants, bakeries, dental practices, HVAC and plumbing companies, venues, event services, and similar. Our services include:

  • AI receptionist that answers your phone 24/7 in your voice
  • AI chat widget on your website, same voice and knowledge as the phone agent
  • Lead capture with name, email, phone, and the customer's request
  • Text and email summaries of conversations sent to you or your staff
  • Voice guide tuning — shaping the AI to sound like you
  • Monthly health check reports and ongoing optimization
  • Optional add-ons: custom FAQ training, review response drafting, emergency triage, seasonal outreach

Engagement and Eligibility

Eligibility

You must be at least 18 years old and legally able to enter into contracts. Our services are intended for business owners and their authorized representatives.

Free Trial

Every engagement can start with a free 7-day trial. During the trial we learn about your business, stand up your AI receptionist, and include 30 minutes of real calls. No credit card is required during the trial.

Confidentiality

Information shared during onboarding and ongoing engagements is treated as confidential. We will not disclose your business details, voice guide, customer information, or engagement specifics to third parties without your explicit consent, except as required by law or as necessary to deliver the service through our vendors (listed in our Privacy Policy).

Billing and Plans

Plans

Bearing offers three monthly plans: Starter ($49/month, 100 minutes included), Growth ($99/month, 300 minutes), and Pro ($199/month, 1,000 minutes). Overage rates and current pricing are posted at getbearing.co. Plans are billed monthly.

Free Trial

The 7-day free trial is available to new customers and includes 30 minutes of calls. You are under no obligation to continue to a paid plan after the trial.

Cancellation

You may cancel at any time by notifying us. Upon cancellation, you retain access to all conversation logs and deliverables produced during your engagement. No partial refunds are issued for unused time within a billing cycle.

AI-Generated Responses and Deliverables

Nature of AI Outputs

Bearing uses artificial intelligence (powered by Anthropic's Claude and similar providers) to answer calls, respond to chats, draft summaries, and generate reports. These outputs are informational tools to support your business — they are not legal advice, medical advice, financial advice, or a substitute for your own professional judgment.

Accuracy

AI-generated responses may contain errors, omissions, or inaccuracies. Safety-critical decisions (medical emergencies, life safety, financial transactions) should never be made by the AI alone. Where appropriate, the AI will escalate to you or your staff.

Correction and Refinement

Your feedback on AI responses is a core part of how your receptionist improves. Corrections you submit are captured and used to refine your custom voice guide. This correction data is specific to your engagement and is not shared with other clients.

No Training on Your Data

Data sent to our AI providers is used solely to generate responses for your customers and deliverables for you. Your business data is not used to train third-party AI models.

Input Sanitization

All user-provided text is sanitized and length-validated before being processed by AI. AI responses are validated against your voice guide and business rules to protect against prompt injection and maintain predictable outputs.

SMS and Text Messaging Terms

Bearing sends SMS messages to customers and prospects who have explicitly opted in, through either the opt-in form at getbearing.co or a signed client services agreement. These terms apply to our SMS program and are in addition to the SMS section of our Privacy Policy.

Program Type

Our registered A2P 10DLC campaign is a Customer Care campaign. Messages include operational alerts, service updates, feature announcements, and account notices. We do not use this program for unrelated marketing, affiliate offers, or content in prohibited categories (cannabis, firearms, gambling, adult, hate speech, or unlawful services).

Message Frequency

Message frequency varies and depends on your activity with Bearing. Typical enrolled users receive fewer than four (4) messages per month.

Carrier Disclaimer

Message and data rates may apply. Charges for messages sent or received are billed by your mobile carrier under your plan. Carriers are not liable for delayed or undelivered messages.

Opt-Out (STOP)

You can opt out at any time by replying STOP to any Bearing SMS. After you send STOP we'll send one final confirmation message, then we'll stop sending texts to your number. To re-enroll, opt in again through the website form or contact us directly.

Consent Not a Condition of Purchase

Opting in to SMS is never required to use Bearing's services. You can use every paid plan and the free trial without opting in to text messages.

No Sharing of Mobile Numbers

Phone numbers you share for SMS are not sold, rented, or shared with third parties for their marketing, and are never shared with affiliates for their own use. Numbers are shared only with Twilio (our SMS delivery vendor) for message transmission.

Intellectual Property and Data Ownership

Your Data

You own your data. Your business information, voice guide, customer conversation logs, and any deliverables produced during your engagement belong to you. You may request copies of all your data at any time.

Our Methodology

The Bearing methodology, frameworks, tools, and underlying technology are owned by us and protected by intellectual property laws. Your engagement grants you use of the AI receptionist built for you during the engagement, but not our underlying methodology or technology.

Aggregated Insights

We may use anonymized, aggregated patterns from across engagements to improve our methodology (e.g., common call patterns, typical response-time benchmarks). This data is stripped of all identifying information and cannot be traced back to any individual business.

Acceptable Use

You agree not to:

  • Use our services for any unlawful purpose
  • Use our SMS program to send unsolicited, deceptive, or prohibited-category content
  • Misrepresent AI-generated responses as live human communication in contexts that would be deceptive or illegal
  • Share or resell your voice guide or AI tools to competing AI service providers
  • Provide false or misleading information during onboarding
  • Reverse engineer our methodology, frameworks, or technology

Limitation of Liability

To the maximum extent permitted by law, Bearing and its operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from our services, including but not limited to:

  • Business decisions made based on AI-generated responses or reports
  • Inaccuracies in AI responses, lead capture, or summaries
  • Lost revenue, deals, customers, or business opportunities
  • Service interruptions, carrier failures, or data loss

Our total liability for any claim arising from our services shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

Indemnification

You agree to indemnify and hold harmless Bearing and its operator from any claims, damages, or expenses arising from: (a) your use of AI-generated responses and deliverables, (b) your violation of these Terms, (c) actions taken by you or your staff based on our outputs, or (d) information you provide during engagements.

Termination

Either party may end the engagement at any time. We may discontinue services if you violate these Terms or engage in conduct harmful to our business, our vendors, or your customers. Upon termination, you retain all deliverables produced during your engagement. Your business data and conversation history will be available for export for 90 days, after which it will be permanently deleted unless you request otherwise.

Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via email. Continued engagement after changes take effect constitutes acceptance of the updated Terms.

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in California.
